What is a patent?


A patent is a document that describes an invention and is issued by the United States Patent and Trademark Office. A patent gives the patent owner the right to exclude others from making, using, offering to sell, or selling the invention in the United States or importing the invention into the United States. To obtain foreign protection for an invention, a foreign patent must be obtained. The term of a patent is twenty years from the earliest filing date of the patent.

What is a trademark?


Trademarks are words, names, or symbols that enable consumers to distinguish goods or services as well as identify the sources of the goods or services. A federal registration for a trademark is issued by the United States Patent and Trademark Office. A trademark registered in the United States Patent and Trademark Office does not give the owner of the trademark rights to the trademark in foreign countries. To obtain foreign protection, trademark registrations must be obtained in the desired foreign countries.
