FOCUS OF PRACTICE


His practice includes drafting and prosecution of patent and trademark applications, patentability and infringement opinions, preparation of expert reports, serving as an expert witness on patent examination policy and procedure as well as inequitable conduct issues. He also advises clients on 35 U.S.C. §101 issues, particularly with respect to business methods. 




ACCOMPLISHMENTS


  • Former Deputy Commissioner for Patent Examination Policy at the U.S. Patent and Trademark Office
  • Established patentability guidelines for examiners regarding obviousness and patent eligibility (§ 103 and § 101)
  • Served at the U.S. Patent and Trademark Office for 40 years
  • Former Primary Examiner and Group Director
  • Negotiated labor agreements with government unions
  • Prepared expert reports on patent examination practice and procedures
  • Served as expert witness in proceedings concerning U.S. Patent and Trademark Office practice and inequitable conduct
  • Oversaw the reorganization of the former Patent Examining Groups into the current Technology Centers
  • Achieved the rank of Meritorious Executive in the Senior Executive Service
  • Drafted and prosecuted hundreds of patent and trademark applications.

TECHNOLOGY AREAS


John’s expertise includes oilfield equipment, downhole tools, business methods and medical devices. John has extensive experience dealing with patent eligibility issues under 35 U.S.C §101 and particularly in the area of business methods. He was the Group Director of the business methods examination group for several years while at the U.S. Patent and Trademark Office and also served as the Group Director for medical and surgical devices examination art units.
